By using the Services, you agree to be bound by these Terms and acknowledge and agree to the collection, use and disclosure of your personal information in accordance with Divikart’s Privacy Policy.

Delivery may be conducted by each individual Personal Shopper’s select method of transportation. You acknowledge that transportation or logistics services are provided by third party independent contractors who are not employed by Divikart. Unless otherwise specified, you acknowledge and agree that Divikart and the Personal Shopper are acting as your agents in the picking, packing, and/or delivery of goods purchased by you and are not the seller of the goods to you. You agree that your purchase is being made from the retailer you have selected, that retailer is the merchant of record, and that title to any goods passes to you when they are purchased at the applicable retailer’s store. 

When you use the Services to place an order for products, you authorize the purchase and delivery of those products from the retailers you select. Unless otherwise indicated, all prices and other amounts are in the currency of the jurisdiction where the delivery takes place.

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions that may relate to pricing, product descriptions, promotions offers, and availability. Divikart reserves the right to correct any errors, inaccuracies or omissions and to change or update information or refuse or cancel orders if any information on the Services is inaccurate at any time without prior notice (including after you have submitted your order ). Please note that prices of products on the Services may be different than prices offered for the same products in-store by the same retailer.

Eligibility

EligibilityServices of the Site would be available to only select geographies .

(Unites States of America) Terms of use require all account owners to be atleast 18 years of age. Minor under 18 years of age and 13 years of age you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. You are responsible for any activity performed on your account by minor. We do not knowingly sell as that term is defined under applicable law.

(India) Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Site. If you are a minor i.e. under the age of 18 years but at least 13 years of age you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited

Account and Registration terms

If You use the Platform, You shall be responsible for maintaining the confidentiality of your Display Name and Password and You shall be responsible for all activities that occur under your Display Name and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Platform and refuse to provide You with access to the Platform.

Your mobile phone number and/or e-mail address is treated as Your primary identifier on the Platform. It is your responsibility to ensure that Your mobile phone number and your email address is up to date on the Platform at all times. You agree to notify Us promptly if your mobile phone number or e-mail address changes by updating the same on the Platform through a onetime password verification.

You agree that Divikart shall not be liable or responsible for the activities or consequences of use or misuse of any information that occurs under your Account in cases, including, where You have failed to update Your revised mobile phone number and/or e-mail address on the Website Platform.

If You share or allow others to have access to Your account on the Platform (“Account”), by creating separate profiles under Your Account, Vendor registration, or otherwise, they will be able to view and access Your Account information. You shall be solely liable and responsible for all the activities undertaken under Your Account, and any consequences therefrom.

You have to keep your account and registration details current and correct for communications related to your purchases from the site. 

Before buying the items/products from sellers in DIVIKART, please be make sure the seller country is same as where you browsing the seller shop page. For any wrong placed orders DIVIKART is not responsible.

Charges

All buyers have to register and login for placing orders on the Site. Account registration on the Divikart platform is free for buyers.Does not charge any fee for browsing on the Platform. Divikart reserves the right to change its terms from time to time. 

Divikart is not responsible for any payment made by customer directly to seller, it should be between customer & the seller only. Any refunds or wrong transaction customer & seller should discuss and resolve on their own.
